Here is the situation. I moved down to Florida in January. We needed a 3rd roommate and I was not in Florida at the time, so my friend got one. Problem is, she never got our new roommate to sign a contract to live with us. The lease is my friend and I. The new girl agreed to live with us until August, when our lease is up. Now the girl is moving in with her friend, and she want's to leave in June, thus sticking us with June and July's rent. Legally is their anything we can do to force her to help us out with the rent, or are we SOL Also she doesn't see how she is screwing us over. shes a real *****
its what I figured. How selfish can a person be? thats why its always good to get things done in writing.
It's a ****ty situation but you really have no leverage. Correct me if I'm wrong but I assume you and roommate A signed the lease... but roommate B was told she could live there by roommate A for X amount later on. This could mean you're breaking your lease anyways if your landlord didn't know about the added roommate.
yes and yes. We were suppose to tell the land lord if we got a new roommate, Roommate A was suppose to do that when my other friend who was left suddenly, and is on the lease left but she never did. my fault too because I should have made sure it was all taken care of properly, atleast when I got here. Wasn't a problem up until now. She even told Roommate A that if she left early she wouldn't leave her high and dry.
Do your best to line up another roommate before June is the only advice I could offer... Sucks but she's got you by the short and curlies...
So if she's not on the lease, that suggests to me she's a guest. I'd say line up a renter for ASAP and kick her the **** out. Two can play at the short and curlies game.
Can she do anything to get the money she already paid for this month? She said she will stay if I move out so her friend can move in for two months. I told her to **** off, I still have three months here. I want to tell her that ill leave at the end of the month, rent is due the 25th, she pays and then once the check clears tell her I changed my mind. Kicking her out early is another option.
It is very possible that should be able to do something but is she really going to sue you? You should probably look at some Florida Legal aid website and check out landlord-tenant law in your state. Consult a lawyer if you can't figure it out for yourself. While you may happen to know that I'm a lawyer in Virginia I am not a Florida licensed attorney.
The idea basically if you ask me is either she's a tenant or a guest. If she's a tenant she has to follow the rules of the lease or at least what common-law is in Florida. If she's a guest and doesn't have any obligation to you then you can kick her *** out.
meh, do her toothbrush, then you can laugh everytime she brushes her teeth. as far as the original question; best to lineup a new roommate that is willing to come in two months early before they sign the new lease with you two. can you two not make rent for two months with just the two of you?
I mean we can since we already paid for the last month when we first signed the lease, so its only one months we are paying a lot extra, its just its going to be tight now that we have to spend money on something we didn't think we would. Also she got a free ride for the last months, because my friend who moved back home already paid for the last month. My roommate told her that and that she didn't have to pay because of that, which pissed me off because we all should have shared that, and we both should have got money back. But we were nice enough to let her be rent free for July, and she comes around and screws us off for June and July's utilities. Unless I leave early, and her friend moves in. She keeps saying she gave us options, but in reality she gave me a ultimatum. Her thinking that she is doing nothing wrong pisses me off the most. What also pisses me off is that she quit her job making 700 a week because she hated it, and is now complaining she has no money. Everyone hates their job, I moved here and two months did not have a job. I found a way to pay rent and make things work, she can do the same. She is using the fact that she is not liable contract wise, and she can leave without being penalized.
It sucks man, I hear you... these situations say a lot about a person IMO. However you guys essentially dug your own grave and she is willing to take advantage of that. Is she wrong that she isn't liable? No. Is it ethical? Not at all IMO. Just another tip, if/when you move into a new place, be sure to take a bunch of photos before you move in... don't know if you have before but my old roommates and I had to learn this the hard way 2 years ago.
Yeah is a big lesson learned, Karma will get her and I hope I am their to see it! It's going to be an awkward rest of the month. She had to break this news on my birthday off all days! nice birthday present jerk!
Post provocative pictures of her on this site...that will teach the b----. Sent from my SPH-L710 using Tapatalk 2
I'd kick her butt out rent be damned. Find a way to make it work. No need to hang around someone like that IMO. I have a very low tolerance for idiots. As far as legal options, I'm not a lawyer much less familiar with Florida law but if nothings in writing I'd say its safe to assume you're SOL. Get a new roommate ASAP so you can leave her stuff on the doorstep. This ain't mommy and daddy, she doesn't get to live rent free either.
Completely counterproductive. Like someone else said, he'd be starting another "legal advice" thread shortly thereafter. Maybe he should PM?
Everyone hates their job sometimes. I love my job, but there are moments when I'd rather be undergoing a root canal without a local than doing what I have to do right at that time.
How did you find her? Email? Text messages? if you can pull any sort of information like that it could really help your case and give you some leverage. Additionally, in Florida a verbal contract is as valid as a written one; that being said, it would be hard to prove with no evidence at all.
You could also kick her out of the place now if you want... if you have no agreement with her. That is your fight fire with fire tactic, which could work.
More information: 1.) You offered her to live there for x amount of time 2.) She agreed 3.) She moved in with you guys
Thanks for the info! My roommate was desperately looking for a roommate. Her friend at work matched them up. She agreed to live their after that We have all that so ill talk to my roommate.(my friend not the *****) Sent from my iPhone using Tapatalk
If I were you I would go one of two ways: 1.) Tell her since you do not have a "contract" you decided that you no longer want her to live there and try to kick her out. Maybe this will help her see things your way. 2.) Bring up the legal issues implications with a verbal contract and tell her you have evidence (pictures of her stuff there) and 3 witnesses (you, your roommate, and her friend at work). Give her the option after you explain your stance. She will probably see things your way or leave (freeing up the space to get another roommate), or negotiate a "buy out" of sorts... ask for half a months rent for the month she will be moving out, etc.
Yeah, until you sit your *** in that chair, sober, with the drill going full steam. Then you would be willing to work 90hr weeks to solve the JFK murder
Seriously you are awesome. Me and my other roommate are going to sit her down and be like look, we have a verbal contract that you agreed upon to live hear until August paying rent, show her the details of the florida law and make her pay!
update: We threaten to sue her, and well she is still leaving at the end of the month, to like 3 houses down from us. Good news is that she is paying this months rent. We pay 1550 a month split 3 ways, her new house is 2000 grand a month split 3 ways. They have a pool so she thinks that she is only paying 100$ more a month, but doesn't realize that the pool is going to make their utilities go up a lot, especially if they keep the pump always on, and well I am not going to say anything, she is going to be screwed for the next 14 months
What if the glove fits? You'd need quite the law bomb lob from Bob Loblaw to get out of that pickle. Sent from my phone using Fapatalk 2
She's moving out Monday and paying the rent! So excited! And I just can't hide it. I'm about to lose control! And you know what? I think I like it Sent from my iPhone using Tapatalk
