    I finally finished the whole thing. It was interesting, but unfortunately Brandon Marshall couldn't stop talking over people and talking over himself. For instance, at one point he asked Flores to explain some of the situations where he was treated differently by ownership (great question) but then Marshall just kept talking and ended up on something else entirely. There's nothing really new here except for Flores talking about his family at the very end.

    Sadly, Omar was the voice of reason on that podcast- Marshall and Ocho just couldn't stay on topic or with a single topic. Flores really spoke very little because he wasn't given a chance to. So the one thing I learned from this; Marshall definitely has ADD and possibly is bipolar. It explains a lot of why he didn't work out in Miami.

    I like that Omar brought the whole “tomlin was too hiphop for the dolphins”.. i forgot about that bull****.. i also forgot that cam did have a terrible first interview and still got the job even tho Tomlin impressed.

    Connecting those dots I see why Tomlin reached out to Flores and got him a job.

    Tomlin and the steelers are made for each other. I'd have loved him in Miami, but it's hard to imagine him being successful here.

    Oh, one other nugget I forgot about until just now. Flores had a guaranteed 5-year contract, so he was supposed to get paid the next two years. However, he had to sign a separation agreement that stated he couldn't sue if he signed it. He talked that out how unfair that practice was- you can either get paid or seek legal recourse...you can't do both.

    If he signed, there was also a non-disclosure where he could never talk about anything that happened there. So he decided to skip being paid in order to tell his story.

    You know, and I could very well be wrong but uh…Grier is the one buying the groceries. You can only cook with what you have.

    No matter how similar they are in appearances, you can’t substitute sugar with salt and that’s what Flores was being forced to do

    If that's the case though, the NDA language would have to be written in the original contract. You can't guarantee a contract and then later, at the time of dismissal require an NDA to get paid.

    So that would mean the NDA was part of the original contract and not a result of the events occurring after, which to me alters the narrative a bit.

    I'm not a legal expert, but the original contract would cover while you're an employee. Some also give clauses like, "You can't talk about your job here with the public or the media for x years" (that was in my contract when I worked in a prison, and again at a hospital). But if that's not there, then it would end when you leave the company.

    In Flores case, it sounds like they wanted to extend that policy in order for him to be fired w/ pay, which makes me think it was not stated in the original contract. He could have been paid for two more years and stayed quiet, or used the NFL's mediation to privately make a case. But he opted not to.

    Well Omar said it there, The Steelers did the once in a lifetime moment where they gave a black man the head coaching job that already had a franchise quarterback in his prime with a top defense.

    it only has been done two other times with Dungy and Caldwell.

    Anthony Lynn was fired after Herbert was crushing rookie records.. and that team wasnt that much better the following season with Brandon Staley

    Sounds like a ton of conjecture. Nothing anyone would expect to verify.
    If any of it happens then they can claim pre-knowledge, if none of it happens it's because it was all in the background, something didn't align etc...

    Still, there will be a ton of chatter about this.

    Or more likely sell his story. He doesn't seem to be much of a businessman and for now, I find him lacking in integrity. There was nothing presented in the above information that would cause me to change my mind.

    I wonder how he would respond to the question - What happened to cause last year's bad start and strong finish? I currently believe at this point he would say something like "It's not professional for me to go into that right now" even though he can say it because he didn't sign the NDA.

    You can't have your cake and eat it at the same time. Now, when I think about how poorly he handled the time clock during the game I'm beginning to see why. He gets blinded by pressure - real or imagined.

    I mean Tua was injured, Parker was injured, Davis was injured, Howard/Jones were both banged up/injured plus we were starting 4 rookies all the while we played 4 playoff teams.

    That is a good point. Javon Holland went from spot playing/good for a rookie at the beginning to a top 5 safety in the league. Jaelan Phillips went from an athletic rookie to a very good player and pass rusher.

    Wouldn't the NFL be throwing Ross to the proverbial wolves by denying arbitration? Seems like it would speak volumes about how he is viewed by other owners?

    Whatever merits Flores has on legal grounds is getting washed away by headline chasing by his lawyers. That may work if the goal was to shame the NFL into a settlement, but by brining in teams other than the phins into it they’re turning it into trench warfare.
    Trying to avoid arbitration makes zero sense for the NFL and the teams, so asking them to waive arbitration is like peeing in a wetsuit - it gives you a nice warm feeling for a few minutes but does you no good. Although a very aggressive team might choose to waive arbitration if their goal becomes humiliating Flores

    I don’t think Flores is asking for a settlement. I think he wants Stephen Ross to lose the team, which would actually be a great thing for Dolphins fans since it would rid us of that absolute embarrassment of an owner.

    If he wanted to do that he wouldn’t be banging on about systemic racism and calling John Elway a drunken racist. He could just have filed his grievance specifically tuned to the ‘pay to lose’. By tying the systemic racism and pay to lose issues together he’s weakening both cases.

    If he wanted to force the NFL to make Ross sell the team he’s chosen the worst way to do it. However if he’s butt hurt and thinks he’s so much betterer than any other coach in the NFL and wants a national pity party for Flores he’s going about it the right way.

    He then sent that memo to dolphin leadership. It's a classic CYA move. It adds merit to his claim.

    What's amazing to me, in regards to the other allegations agains the cardinals and titans, is that so many of these teams have yet to learn what normal businesses have already learned. You don't tell someone they are hired until after the interview process. Even if you know you will hire them because if it gets out, lawsuits are inevitable.

    I don't like the Arizona claim. How can a coach claim he would have had similar success as another coach based off that coaches success? Maybe if you agreed coaches make little or no difference to the teams success you might believe that.

    Titans coach has a legitamate complaint. Though if the titans interviewed a white coach after Mularky it'll be difficult to say it was racially motivated. Rough getting a lawsuit and having to deal with the failure of mularky.

    Assuming the Flores memo exists, why isn’t it quoted in his claim?
    If you've got solid gold like that, then as a lawyer you put it front and center in your claim. Possibly Flores didn’t keep it, but that then begs the question of why even write it in the first place. My guess is that it exists, but the lawyers need to set up the spin beforehand to make it sound more like the way they wish it would.

    The Arizona complaint falls flat when you look at the record of the cards from 2013 when Steve Keim was appointed GM and the records of the other 2 Coaches (Bruce Arians and Kliff Kingsbury). Wilks took over an 8-8 team and crashed it to 3-13 and Kliff Kingsbury took over the 3-13 and rebuilt both the offense and defense.

    As for the Titans claim, what was the harm done to Horton? He got an opportunity to interview, that a non-POC coach wouldn’t have been given. He lost nothing, apart from his time to prepare and conduct the interview. His post Tennessee interview coaching career shows nothing to support a claim he was a superior candidate who would have won the job on merit.

    The fact that 2 other coaches have signed on reaffirms my view that this case has been run primarily to drum up business for the law firm.

    For hiring a lackluster coach like Wilks in the first place?

    I’ve had a quick review of his record as DC at Carolina and at Cleveland before and after his turn at the Cards and apart from one good year with Carolina there isn’t a whole lot there.

    Still, he is not lying. What he said in the lawsuit happened, and it was weird how he was fired. Especially after dealing with all that uncertainty. Then he got replaced by a middling college coach.

    It’s not weird to get fired after going 3-13. Especially when in the prior year you were 8-8.

    Kingsbury was seen as some kind of offensive innovator and was also interviewed by the Jets for their HC gig. As a sidebar the Jets chose Adam Gase to be their offensive genius HC, so we do owe thanks to Arizona for choosing Kingsbury and letting the Jets take Gase.

    He was a middling coach in college. Adam Gase at least coached in the NFL.

    It is weird getting fired after one year with Josh Rosen as your starting quarterback. It would take Bill Belichick in his prime to get 5 wins out of that team.

    Plus they were 5-11 the next year with a better quarterback.

    That entire situation was weird. I thought so then, and i think so now. He is a much better case than Flores.
