Mrs. Marshall violates restraining order

    All the beat guys have it on Twitter.

    911 hang-up from the residence this morning results in her arrest. Caller's name has been redacted in the police report. Mrs. Marshall claimed she was staying at the home while Brandon was gone. The judge's order was to stay 500 feet away.

    One of the beat guys speculates that this development could help Brandon if/when Goodell gets the chance to punish him for the stabbing incident (e.g. he's the victim).

    EDIT: CBS4 has it.

    Video says that, like last time, neither one wanted to cooperate when the authorities arrived.

    I've known women like this, and things never end well, only in varying degrees of bad.

    Scary thing is that Chris Henry knew a woman like that too.

    Lets play hypothetical... if he had killed her upon finding her in his residence unlawfully, could it be justifiable? It's dark, he sees a shadow coming at him, he's armed and takes her out... justified right?

    It doesn't look good that 911 has been called twice and the end result is one stabbing of him and two trips to jail for her.

    I'm not gonna judge either way -- because none of us know anything about what led up either time -- and quite frankly don't like posting about players' personal lives. But it relates to his possibly missing time this year.

    No. Contrary to popular opinion, there are still rules when confronting an uninvited stranger in your own house. It's not just open season like so many people believe. Also, spring-loaded shotguns are not an approved home security device. Torts 101.

    So, what rules we gotta follow? Keep an unregistered gun around to place in the dead perp's hand before the coppers arrive? I'm very disappointed to think that if I confront a stranger who has broken into my home, that I can't just simply cut him in two with a round of buckshot.

    I don't think DJ was referring to looks, not that they matter in this case, and beauty's in the eyes of the beholder anyway, and most people have only seen her mug shot and how many people ever look their best, or even their usual self, in a mug shot or on a driver's license too for that matter. Also, not everyone can be as beautiful as you in your avatar, or your gf in your avatar if you're a dude, or your dream girl if it's not you or your gf.:shifty:

    It's a bad combination of crazy and prone to call 9-1-1.


    As for shooting someone in your home, the basic rule is that you can use reasonable force to defend yourself or others. It is not reasonable to use lethal force to defend property. However, the basic assumption is that if you shoot an intruder in your home then you are acting reasonably to defend yourself or your family. That doesn't mean "open season", but it does mean that barring other facts police and prosecutors don't tend to go beyond that basic assumption very often (if ever) when a person shoots an intruder in their home.

    Personally, I can only think of a couple of (relatively) likely situations where I would actually call 9-1-1 to my home; after I shoot at an intruder or if I'll need the police report for insurance purposes. And both of those are about covering my butt for legal purposes. For myself and many others the days of believing or expecting the police to protect you are long gone.

    He has to feel genuinely in imminent danger for his life or that of another, though. Just her presence in his house, even in violation of a court order, doesn't cover that unless she's armed. Then she's fair game.

    The fact that she already stabbed him once would be huge. If she were even near a knife he could claim reasonable fear of imminent harm and most any prosecutor would buy it.
