    no the fist thing was a joke.
    the stuff sick mentioned about the car picture, etc is already being ignored by the media. I can't see them running with it.

    The whole thing is absolutely hilarious though.

    Shows you the complete lack of a thought process that comes with a lot of people's ideas of bullying and how hypocritical many of them can be with their views.

    FWIW, on Dan Lebatard today, Dan said it was the 2nd time that Martin has quit on the team, the first time was during OTAs, but that it was swept under the rug and his absence was played off as "family time", while in reality they were convincing him to not quit. Maybe the front office is sick of him and just want to be A Holes about the whole situation.

    That is the dispute apparently. Jon Martin believes he should be paid because Richie Incognito constitutes a "football reason".

    Notice how none of this bullying stuff came out until the team made it clear they would be placing him on NFI.

    Just speaking as a lawyer, and somebody generally sympathetic to Martin's issues, I just don't see the lawsuit.

    At this point, it appears that the Dolphins are beginning to clean up the workplace to make it safe for Martin. Incognito is gone. I imagine the team (unless they are monumentally dumb) has put anti-hazing procedures into place. The staff has stated that they want him back when he feels he is healthy to return. If it's true that he never advised Philbin of anything prior to Sunday then I don't see a claim.

    They never acknowledged they have a problem. They acknowledged that someone reported a problem, and they'll have the NFL investigate it.

    Theoretically, you could make the claim that Philbin and/or the organization were or should have been aware of bullying/hazing without Martin specifically telling them.

    I commend the team for not giving in to the media circus. Jon Martin shouldn't be rewarded for quitting.

    The idea of Jon Martin suing the Dolphins isn't realistic. He pretty much signed away a lot of his rights when he joined the NFLPA. I'm not well versed on union law, but I would think it would be a huge mountain for him to climb?

    This was mentioned by Schefter on MNF last night, that Martin recieved the voicemail from Incognito and missed 2 days of some team function. Anyone want to match up dates to verify?

    Well, if Martin had a breakdown because of an incident that occured in relation to him playing football for the Miami Dolphins (something that's still quite possible, maybe even likely), then "quitting" isn't the word I'd necessarily use. I also fail to see how this wouldn't be football related.

    I also used "in relation to". I guess Saban is contaguous.

    Making it go away and paying him would admit a measure in guilt. The Dolphins must feel confident they have no blame in this. Some thing are worth fighting for. Sets a precedent.

    Then it can be argued that nothing, apparently, was different in the Dolphins locker room than any other team. The onus was on Jonathan Martin to let Philbin know of anything that might have been happening that wasn't normal for this standard.

    The standard can be argued, but the Dolphins can't directly be at fault for that, all of the NFL will be.

    @AbramsonPBP So the Dolphins decided not to put Martin on NFI. Very interesting. They'll continue paying him and he will continue to take up roster spot.

    Per NFL's internal transaction wire, the Dolphins did not place Jonathan Martin on NFI today, meaning they'll have to pay him for Week 10.

    Since the NFI list is a new part of CBA, there's been a lot of confusion about it. There was a belief Dolphins had a deadline of today...

    @AbramsonPBP ...but apparently they don't. There also seems to be confusion of whether Dolphins could or could not pay Martin when he goes on NFI

    @AbramsonPBP NFL spokesman told me if Martin goes on NFI, his season is over. But he would not say whether Dolphins would or wouldn't pay him on NFI.

    I'm guessing that in the end they decided it would be premature to take a legal stance on the issue before the NFL's investigation has concluded (or even begun?).

    Also, only a day after every media outlet in the world just blasted you for allowing bullying, you don't put the man on a reserve list that makes it clear you don't intend to pay him.

    Smart move.

    Ugh hope they're just being thorough with the investigation.

    Basically, this guy quit and wants damages after having said nothing up until this point.

    Also, is Incognito automatically ruled out for Week 10 or can we rescind the suspension and have him active whenever we want?
