    Right, the team is saying that this is not the case - that Martin's breakdown was not because of anything football related.

    Well, even the mafia doesn't argue that snitching was frowned upon by every major criminal organization and thus they weren't legally liable for shooting the sucker who went to the police :lol:

    Yeah this isn't going to end well. Dolphins are assuming they're going to get sued so might as well recover what they can before having to pay him a large settlement.

    They're not saying it yet. But I'm pretty sure they plan to (because, ... NFL).

    They really can't start fighting until the NFL's investigation is done.

    But it was. Unless they want to claim that it had nothing to do whatsoever with Incognito's communiction. Which would be pretty tough considering his finger prints are all over the smoking gun ...

    It's not that easy. If the Dolphins are legally liable for creating an unsafe work environment he could sue for damages that would compensate him for a career cut short by the trauma.

    The argument, however, is that the proper course of action was taken as soon as they had found out about it, which was when they made it aware to them on Sunday (I believe).

    The real question is where the line is in regard to what constitutes whether or not it's football-related.

    I don't see how Martin could say he quit over a voicemail from six months ago, which he never even notified the team of.

    Which Martin can't definitively prove so lots of luck to him. He's toast in Miami and it sucks that we blew that pick but aside from losing Incognito for however long or permanently, this wasn't that big a deal.

    Aye, but it's still a football related "injury" given that Martin wouldn't have suffered it if he didn't play football for the Miami Dolphins.

    He quit over an incident in the cafeteria he can apparently trace back at least sixth months, thus establishing a pattern of bullying.

    But this is besides the point, really. I really don't see how Miami can establish that this was a non football injury.

    Did he suffer the injury in the workplace? By literally all accounts, he did. Thus, football related.

    If he has a prolonged record of similar type incidents, then he'd have a case. As it stands he has one random voicemail, which we don't even know the context of.

    This wasn't a big deal. But it certainly could become one if any parties involved decide to air out some dirty laundry (Martin and/or Incognito).

    The link between what happened in the cafeteria and the voicemail/text messages is non-existent. The Dolphins can easily show this by simply marching up a few witnesses who will testify that Jonathan Martin played the same exact prank (along with everyone else) on Nate Garner one week prior, when Garner was the last person to sit down with his tray of food.

    The cafeteria incident is laughable. It literally was a harmless joke that any normal adult should be able to handle. No way does it constitute bullying.

    If a player breaks his leg in the weight room, he doesn't have to prove a prolonged history of breaking legs. It's a football related injury.

    I have a hard time believing that Jon Martin developed a mental illness suddenly because of a cafeteria prank.

    Again, whether or not he can prove a bullying case is a totally different story. But there's literally no way Miami can establish a non football injury when the injury occured at the workplace.

    Call it a pre-existing condition then. Same deal. If the player who broke his leg in the weight room had a long history of breaking stuff, it's still a football related injury.

    Going by what's out there, it looks like he's a troubled kid with self-esteem issues who simply caved under the pressure of a competetive (and sometimes nasty) environment.

    I doubt it. Everyone has already made up their mind and have concluded Richie is a psychotic monster.

    People always want heads to roll. This thing will continue to snowball until multiple people "pay for this", because of course, someone has to! I doubt it's Martin.
