8th Circuit grants NFL’s request for stay, lockout resumes

Desidesforum_veteranOPAlthough the players were being welcomed back to team facilities this morning because of Judge Susan Nelson’s injunction to end the lockout, that is changing this afternoon.
ESPN is reporting that the U.S. Court of Appeals for the Eighth Circuit has granted a temporary stay of the injunction and reinstated the lockout, meaning players will now be told to hit the road, and doors to team facilities are being locked this afternoon.
Michael Silver of Yahoo reported this afternoon that NFL players were bracing for a ruling from the Court of Appeals that would give the owners an “administrative” stay, meaning the lockout would be back on at least through the weekend.
Then, as soon as Monday, the Eighth Circuit will hear the players’ argument against a stay. At that point, the lockout could be back on, or the players could be let back in, depending on the Eighth Circuit’s ruling. And either way, it would just be temporary until the appeals court makes a decision on the owners’ appeal of Judge Nelson’s ruling.
So just hours after players were let back into team facilities this morning, they’ll know be told that they’re no longer welcome this afternoon. And we’ll all wait until Monday to see what the appeals court does next.

PhinsPhan23New MemberThis is getting old. My patience is wearing very thin for this sport and the greed involved. It's very ironic how much this is affecting the little people yet the owners and players are the ones getting the "woe is me" publicity.
It's really too bad they couldn't just bring in replacement players and be done with it. I would route for the Dolphins just as hard with replacement players and maybe that will open the eyes of both the players and owners that Football is just not the same when you are too greedy.

padre31luxury_boxEh, sounds like de rigeour temporary injunction the NFL's problem is they need not only a longer term injunction they also need a reversal of Judge Nelsons' entire finding of fact which will not happen, however if it does the matter is simply handed right back to Judge Nelson but with 8th circuit guidance.
Contrary to popular opinion it is quite difficult to have a finding of fact tossed out.

Silver lining: this is just a temporary stay. Another ruling will be issued next week.

Desidesforum_veteranThe NFL’s request for an expedited hearing has been granted. Arguments in front of the 8th Circuit (the same three judges who granted the temporary stay of Judge Nelson’s ruling) begin one month from today, on June 3.
As we explained last week, the eventual ruling could turn on the standard of review that applies to the various aspect of Judge Nelson’s decision. Generally speaking, decision to grant motions for so-called “preliminary injunctions” are overturned only if the judge abused his or her discretion. Lawyer David Boies told PFT Live last week that, in his view, certain aspects of Judge Nelson’s ruling should be reviewed from scratch, with no deference being extended to her reasoning or result.
We’ll know more about the specifics of the parties’ arguments soon. The league’s brief is due May 9, and the players’ response will be filed on or before May 20. The NFL gets the last word, on May 26.
Still unknown is whether Judge Benton and Judge Colloton will decide to grant the full stay. If only one of them agrees with Judge Bye, the lockout will be lifted pending resolution of the appeal. If both judges find that the stay should be granted, there will be a whole lot of nothing going on in the NFL between now and the resolution of the appeal.
