As stated it's best to reserve judgment until we know more. However, I also thinks its important to keep an open mind - ie: not call it probable BS just because it happened a year ago.
Roethlisberger is not facing any criminal charges, and it's unclear if McNulty ever tried to file a criminal complaint before taking legal action against him.

So in other words, its not known at this time if the woman first tried to pursue criminal charges or not.
If she did it could very well have taken several months for investigators to determine that there wasn't enough evidence to file criminal charges. If that was the case then it doesn't necessarily preclude civil charges. Rules of evidence are different. -
