Word is they were holding out to hear the ruling on this as it would have allowed them to operate with impunity.
I've been waiting for that ruling. The loss by the NFL maintains the status quo so I still think a lockout is likely. But a win by the NFL would have allowed them to operate with impunity as you said. It could have led to an effort by the NFL to completely destroy the union, going as far as having a return to the scab games with many of the current stars leaving prematurely and never returning. IMO, we as fans are best served by a little more balance in the system.
