In other words, he wasn't just found "not guilty" due to insufficient evidence. He was found INNOCENT due to the fact that the evidence proved he was not the murderer. ;)

I would not make that comparison until I see him play in our uni on a pro field against pro players, I did say that from the reports that ive been hearing that it sounds like he has some Bob Sanders in him..

The first trial had a hung jury. He faced trial again and was acquitted. Guilty, not guilty and innocent are all different.

Well I don't see the Sanders comparison, but let's hope he is nowhere near as injury prone as Sanders.

 

Juries are asked to return a verdict of guilty or not guilty. Simple as that. If they return a verdict of not guilty, that results in an acquittal. The judge does not give the jury 3 options, such as innocent, not guilty or guilty.

You're partly right and I was partly wrong.

An acquittal doesn't necessarily mean a person is innocent as I first thought.

However, "Innocent" and "not guilty" are not the same things.

If I came off as treating Andres harsh, I apologize to him that was not my intention. It was late, I had been awake for nearly 20 hours. I also re-read his last post and he was correct in that there is a difference between a hung jury and acquittal. I misread his post. However, I never said they were the same thing in the first place.

 

The jury in Wilson's case found him "not guilty", which is why he was acquitted. They never said he was innocent and did not need to. That was not an option for the jury. I recall that being your original point, Wilson being found innocent, rather than merely not guilty. While he for all practical purposes is, there was not any court ruling proclaiming him "innocent". The defense does not need to prove their client is innocent. They only need to show there is not sufficient evidence to find him guilty. Whether one wants to make a big deal out of different meanings for 'innocent' and 'not guilty', the result for the accused is same. However one wants to say it, he becomes a free man.

Since you said I'm partly right, that means in your opinion I was not totally right. What about that post is not correct in your view?

 

Again, I mistakenly thought that "acquitted" equaled innocent. You're right in that a jury only chooses "guilty" or "not guilty". When I was in college I took a few law classes and thought I remembered a prof telling the class that an "acquittal" is different from "not guilty" in that the former is "innocent" and the latter is just that the jury wasn't convinced the party did it due to lack of evidence. In other words, an acquittal was given when the party was innocent and a not guilty was given when the prosecution didn't provide enough evidence for a conviction.

I took from your post that you thought "innocent" and "not guilty" were one in the same. That's where I think you were partly wrong. If that's not what you think, then you're not wrong at all. In fact, this is what my point has been all along...that "not guilty" does not equal "innocent". Where I was wrong is when I mistakenly thought one of my college prof's said that "acquittal" equaled "innocent".
