overall, that sounds like it sucks. Sorry to hear that this happened to you mor. I don't really know anything as to your brother's history other than what you just said, so I have no idea what kind of 'force' they thought might be necessary if they were under the impression that someone was in your apartment.
It was most likely not the officers' who made the raid call to do this, they were likely doing what they were told from their detectives, captains, etc. Their man in charge likely didn't know much more than he told you, that supposedly someone was at your place. Unless it was a detective himself running it, then he may have.

You're a good guy and we all know you are harmless, but to the police I suppose they really have no idea who you are or what you believe, right? Cuffing you and putting you aside while they searched the apartment, while scary as **** to you, would be pretty commonplace, so long as they weren't manhandling you, so to speak, in the process. They need to make sure you aren't going to pull any shenanigans while they have their backs turned but at the same time you are not the person whom they are searching for, so there's no need to be rough with you.

Doesn't necessarily sound like they had a search warrant per se, but if it was a consensual search then what they did as far as coming in would appear to be legal.

Anyway, thought I'd get in before the 'f the popo' people start up, but I feel for you man. I can't imagine haven't that done to me. I'd be scared and pissed and upset too. And again I know nothing of your brother's history, but whatever it was sounds like it wasn't very fun for you at all, and this sure isn't going to help that. We're all here for you though.

 

Well sadly as soon as you said "sure" when they asked if they came in then they are allowed to. I dont blame you I wouldnt have been like "show me a warrant" ecspecially since you didnt do sh-t.

Sounds like you were very honest with them about having a gun and about your brother but fact is alot of those guys are just coc-s-ckers who feel the need to treat EVERYONE like they are a criminal.

Not sure what mix your brother got in but it must have been serious for 6 armed officers to come to the door.

Also its byullsh-t that you have to be afraid when your an innocent man in your own home but weve all seen and read how cops get itchy trigger fingers and its a sad GD situation. And really nothing you can do, file a complaint? Not worth your time....just move on man and try and go about your day.

I won't dispute that there are certainly bad, power-trippy, arrogant etc etc etc cops, but I find myself most times giving the benefit of the doubt, because all the officers I work with (i'm not an officer, only know a bunch) are legit, and they really do take it to heart when people automatically hate them when they personally haven't ever done anything wrong and they're just trying to save lives. But i suppose it comes with the territory.

 

Your exactly right, but when a guy has been 100% honest about weapons in the house, invited them to come in and search, is it necessary to call him a liar when he said his brother had been gone since thanksgiving? Sounds like he had been very coopertive with the officers so I just dont understand the "BULLSH-T" comment.

It is a small percentage im sure that has given the label to the police.

 

Yea I agree the comment was uncalled for. I think likely the guy had no idea and was trying to be arrogant. Or maybe he was testing mor's reaction. Who knows, but with a cooperative subject it doesn't sound like it was necessary

Armed Robbery and Assualt with a deadly weapon would make anyone (including police) nervous and draw weapons. Not defending the comment, but understanding the police call to arms.

Yeah Mor, the thing is you let them in the house, dont do that ever without a warrant....when you invite people into your house, you basically give up control of your house/condo/apt.....etc....you give them the right to search esstentially...the reason why is the "plain view doctrine", which states that anything in plain view can be used as evidence, and is futher cause for a full search of the entire property....so while police cannot search the property upon first entry, it is very easy to find something to raise the level of search under the "plain view doctrine"....so next time no entry if no warrant is presented......now the thing is, you'll piss them off when you do that, so (not saying your ish isnt bro) but make sure your sheet is tight, nothing that can get you in trouble when they do come back with one, cuz when they do come back, they are coming agg....is the gun properly registered to you?? all paperwork up to date?

Lastly do you truely know if he is still in Nic?? You said you saw him around Thanksgiving, it is May.....they might have a tip, or something that he is in the States again, which would immediatedly make him a fugitive, thus bring heat upon yourself....The authorities most certainly always check with immediate family first....

 

This should be a lesson to one and all.....

1) You should always ask direct questions in a slow articulate voice using vernacular the Law Enforcement members thrive on, such as; "May I ask the identity of the two perps in question that you are seeking?"; and "May I ask what they are accused of doing?"

2) When stating facts about your personal situation, one should enunciate and make direct eye contact, such as; "Officer, I enjoyed a lovely Thanksgiving feast with my Older Brother Vince in Nicaragua during the past festive holiday"; and "My younger Brother {add name for emphasis} is in and adjoining boudoir with his femme fatale"

3) If you can wear a monicle when posing these direct quesions, it works best.

This type of behavior is exactly why I have zero respect for the police. They think that it's O.K. to treat people like dogs, and it seems that most people give them a free pass to do so. Not me.

So, because the Mor's brother did a few bad things many years ago, the police have the right to enter his house and threaten him with guns? They guy isn't even in the country! He got deported, and the police are so incompetent, they don't even know it!

The real question is this: He served his time, why are they so concerned about him?

I'm sure if there were 9 armed cops they had a warrant already. My guess is they knock, announce, and if no answer they bust the door down. So by allowing them in you probably saved yourself some more harrassment and some damage.

I think you should contact the police department and complain and also the local news. It may not accomplish a lot but you never know.

 

the policia don't always have their records updated. I know this as one time us marshals showed up at my door step. I too let them in. They were looking for the guy that previously owned the house, pretty sure he's in mexico now. I had guns also 3 of them in my closet and my dad had like 5 in his lol. Needless to say I kept my hands up and told them where the guns were they then told me I looked like the guy they were looking for and asked to see my id. All and all dealing with the us marshals taught me that it was ok to be a man and cry.

 

Well, Vincent was guilty of Armed Robbery and Assault with a Deadly weapon, and you also had a weapon (legally or not doesnt matter).

Their job is to keep everyone safe based on this...so disarming you and then verifying who the two other occupants of the house are and if they perhaps are armed is still priority #1.

Yes, we would all love a calm and straightforward conversation as you wished. However, if they have information which leads them to believe a previously DEPORTED person of interest has returned, and that PERSON regardless of serving their sentence has a known history of ASSAULT with a Deadly weapon they cant afford to take any chances or ASSUME the BEST of YOUR INTENTIONS.

Frankly, it turned out as well as one should ever expect under the circumstances.

 

The fact of the matter is that you did everything absolutely correct. Unfortunately the cops definitely did overreact.

It seems as though the situation escalated when you announce that you did have a gun on you. I completely understand, I could have a gun on myself also, and you have every right in a 5am wake up call.
I understand that you completely cooperated and admitting to having it. But at that point, they are aware that weapons are in the house along with what they interpret as a dangerous person.
The cuffing definitely was a bit excessive seeing that you and your brother were completely compliant. The fact of the matter is that the cops have families to go home to also. They are no doubt hyped up to essentially go into a battle, once a person is in that mentality its human nature to stay in it. They aren't going to take any chances.

You handled everything perfectly. I'm sure they had a search warrant. They clearly could have been less reactionary, and the "BS" comment was absolutely uncalled for.

On the cops point of view actually was probably a textbook raid. Being in that situation sucks regardless for everyone involved.

I aint saying Mor is a bad guy bro, he is IMO without a doubt one of the best dudes on this site, the guy isnt Mor no doubt, but it is Mor's brother, if his brother is in fact back in the States (as the police claim), after being deported once completing his time, his is in violation of the law, he is a fugitive, and the police have the right to go after him, and 9 times out of 10 immediate families is were they start.....may not be exactly what people on this board want to hear, but it is reality....and again if you read my previous post, they dont have the right to search as Mor didnt do anything wrong, hence they asked him to come in.....

the real way to see if the police was pulling your chain Mor, was to deny access to your property, cuz at that point they would have had to have a Judge sign off on a search warrant, and no Judge is going to sign off on any affidavit request without strict evidence proving that his brother is in fact back in the States....any evidence produced from an illegal search and seizure would quickly get overturned by the higer courts, and the Judge who signed off on a bogus warrant would have a black stain amonst their little jurist community....and if in a couple of days they didnt get a search warrant, and they were just harrassing you, then you should immediately go and file a complaint....

Lastly I believe Mor, the brother obviously isnt with Mor, as Mor said he isnt in the States, cause if he was in the States, and was in contact in any way shape of form, and the cops can prove it to be an advantage to the brother, then Mor will be getting charged with aided and abetting....

Dude when you tell the cops there are weapons on said person, they get antsy......did they nightstick him?? did they flashlight him?? no....they cuffed him....I have been cuffed for safety reasons, albeit I didnt agree with them for doing it, I understood why, then when the situation is under control they release you...
